Terms of Service.
These terms govern your use of machahine.com (the "Site") and the free resources we offer through it, including the Systems Check. By using the Site, you agree to these terms. If you don't agree, please don't use the Site. "MaChahine Group," "we," and "us" mean the individuals operating machahine.com under the MaChahine Group name, and any legal entity they later form to carry on this business. Our Privacy Policy explains how we handle information you submit and is part of these terms.
01What the Site Is
The Site describes our services and offers free resources for business owners. Nothing on the Site is an offer that binds us to provide services; all engagements are formed only by a separate written agreement signed by both parties.
02The Systems Check & Free Replies
When you submit a Systems Check, we aim to reply with our general observations based solely on what you told us. We may decline to respond to any submission at our discretion (for example, spam, abusive, or off-topic submissions), and statements about response times anywhere on the Site are goals, not guarantees. You agree that:
- Our reply is general information, not professional advice. It is not legal, tax, accounting, financial, or engineering advice, and it is not a substitute for advice from a licensed professional who knows your situation.
- A reply does not create a client, fiduciary, or advisory relationship. No engagement exists unless and until we both sign a written agreement.
- Our observations are based on limited, self-reported information and may not account for facts we don't have. Any decisions you make — including changing processes, purchasing or canceling software, or personnel decisions — are yours alone.
- Estimates of time or cost savings anywhere on the Site or in a reply are illustrative, not promises. Your results will vary.
03Your Submissions
You are responsible for what you submit. Please don't send us information you aren't authorized to share — including other people's personal information beyond what's reasonably needed to describe your operations. By submitting, you grant us permission to use your submission to respond to you and, if you engage us, to perform the services. You represent that your use of the Site and anything you submit doesn't violate any law or agreement you're bound by. While we keep your submissions private as described in our Privacy Policy, you agree that we are free to use the general knowledge, skills, and know-how we gain from reviewing submissions, and that any ideas or suggestions you volunteer about our business may be used by us without obligation.
04Acceptable Use
You agree not to misuse the Site — including attempting to breach its security, scraping or bulk-harvesting content, submitting malicious code or spam, impersonating others, or using the Site for anything unlawful. The Site and Systems Check are intended for business use; by using them you represent that you are at least 18 and authorized to act for the business you describe. We may refuse, suspend, or discontinue access to the Site or any free resource at our discretion.
05Our Content & Marks
The Site and everything on it — text, design, graphics, the MaChahine Group name, logo, and mascot — belong to MaChahine Group. You may browse and share links freely; you may not copy, republish, or use our content or marks commercially without our written permission.
06Third-Party Services
The Site relies on third-party services, including Calendly for scheduling and FormSubmit for form delivery. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, and links to other sites are not endorsements.
07Disclaimers
THE SITE AND ALL FREE RESOURCES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED — INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
08Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) MACHAHINE GROUP AND ITS FOUNDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR ANY FREE RESOURCE OR REPLY, EVEN IF ADVISED OF THE POSSIBILITY; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE OR FREE RESOURCES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). PAID ENGAGEMENTS ARE GOVERNED BY THEIR OWN AGREEMENTS, INCLUDING THEIR OWN LIABILITY TERMS.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. In that case, our liability is limited to the smallest amount the law allows.
09Indemnification
You agree to indemnify, defend, and hold harmless MaChahine Group and its founders from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these terms, your misuse of the Site, or your violation of any law or third-party right in connection with the Site.
10Changes
We may update these terms by posting a revised version here with a new effective date. Your continued use of the Site after changes take effect constitutes acceptance.
11Governing Law & Disputes
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute arising from these terms or the Site will be resolved exclusively in the state or federal courts located in Ohio, and you consent to their jurisdiction. Each party bears its own costs except as a court awards otherwise.
12General
If any provision of these terms is found unenforceable, the rest remain in effect. These terms are the entire agreement between you and us regarding the Site, and our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale, and these terms inure to the benefit of any legal entity we form to carry on this business.
